Terms of service

These Terms govern your use of Kirk's mobile apps, website, and related services. There are two parts: Section A applies to customers, and Section B applies to businesses that take bookings through Kirk. By using Kirk you agree to whichever section applies to your role.
Section A — Customer terms
A1. Account & eligibility
You must be at least 18 years old to use Kirk. You're responsible for keeping your phone number, device, and OTP private. You're responsible for any activity that happens under your account.
A2. Bookings
Kirk lets you reserve a time slot or join a live queue at participating businesses. The service itself is provided by the business, not by Kirk — we are not party to the underlying service contract.
A3. Fees
Kirk may charge a booking fee per confirmed booking, displayed before you confirm. Some businesses pay this fee on your behalf, in which case you'll see "Free" on the booking screen.
A4. Cancellations & no-shows
See the cancellation policy for the full rules. In short: each business may set its own grace period, and repeated no-shows may lead to a temporary suspension.
A5. Acceptable use
You agree not to:
- Impersonate another person or create fake bookings.
- Harass, abuse, or harm businesses or other users.
- Probe, scan, or attempt to bypass the platform's security.
- Use the service for any unlawful purpose.
A6. Termination
We may suspend or terminate your access if you breach these terms. You may delete your account at any time.
Section B — Business terms
B1. Eligibility
You must be authorised to enter into contracts on behalf of the business you're onboarding. You must comply with all applicable laws in operating that business.
B2. Booking fees
Kirk charges Rs. 50 per confirmed reservation and Rs. 40 per confirmed queue booking. Pilot partners receive the first 3 months free. Fees are billed monthly in arrears.
B3. Your obligations
- Keep your services, hours, and pricing accurate.
- Honor confirmed bookings within the grace period you set.
- Respond to legitimate customer complaints in good faith.
- Comply with PDPA when handling customer personal data.
B4. Cancellations by your business
If you cancel a confirmed booking, the customer is notified and any fee they paid is refunded automatically. Frequent unilateral cancellations may trigger a review of your account.
B5. Suspension & termination
We may suspend or terminate your account for breach of these terms, repeated complaints, fraud, or non-payment. You may terminate at any time with 30 days' notice.
B6. Disputes
These Terms are governed by the laws of Sri Lanka. Disputes are subject to the exclusive jurisdiction of the courts of Colombo.
Limitation of liability
Kirk provides the platform "as is". To the maximum extent permitted by law, Kirk is not liable for indirect or consequential damages arising from the service provided by a business or from your use of the platform.
